Information concerning personal data

The purpose of this Privacy Policy is to explain the personal data processing principles and discuss the basic rights related to the personal data processed by us.
This Privacy Policy also fulfills the information obligation referred to in Article 13 of the Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR).
Please be advised that personal data controller is a company under the business name of El-Cab Spółka z ograniczoną odpowiedzialnością with its registered office in Bolechowo - Osiedle (postal code 62-005 Owińska), ul. Obornicka 37, entered into the register of entrepreneurs of the National Court Register under the KRS number: 46624, whose registration files are maintained by the District Court Poznań - Nowe Miasto i Wilda in Poznań, Eighth Commercial Division of the National Court Register, having the share capital of PLN 50.000,00, NIP (VAT Identification Number): 7771036583, (hereinafter referred to as the Controller or EL-CAB).
EL-CAB represents that its overriding goal is to provide users with privacy protection at a level that at least corresponds to the requirements of applicable laws, in particular the provisions of the GDPR, the Act of July 18, 2002 on the provision of services by electronic means and the Act of July 16, 2004 Telecommunications Law.
EL-CAB shall ensure that the data is processed only to the extent necessary for the indicated purpose and only for the period in which it is necessary.
Each person using the website in any manner accepts all the rules of this Privacy Policy.

Personal data will be processed by the Controller, in particular:

  • for purposes arising from the legitimate interests pursued by El-Cab as the data controller: to provide services to customers, marketing of El-Cab products and services, as well as for analytical and statistical purposes and to ensure the security of the website www.el-cab.com.pl (legal basis: Article 6(1)(f) of the GDPR);
  • to perform contracts concluded by El-Cab with customers, cooperation with suppliers and other entities cooperating with El-Cab (legal basis: Article 6(1)(b) of the GDPR);
  • to recruit people interested in working for or cooperating with El-Cab (legal basis, respectively, Article 6 (1) (c) and Article 6 (1) (b) of the GDPR).

We also process personal data in the extend arising from the fulfilment of legal obligations incumbent on El-Cab (legal basis: Article 6(1)(c) of the GDPR).

Period for which personal data are stored

Personal data will be processed until the relevant legitimate interests pursued by El-Cab as the data controller related to the processing of specific data are realized, until the expiration of the limitation periods concerning the contract to which the processing of personal data is related, or related to the limitation of obligations arising from the law, until an objection to the processing for marketing purposes is raised.

Rights of the data subject

1) the right to access to his or her personal data, i.e. the right to obtain confirmation whether the Controller processes data and information regarding such processing,
2) the right to have his or her data rectified, if the data processed by the Controller which are inaccurate or incomplete,
3) the right to request the Controller to delete data,
4) the right to request the Controller to limit data processing,
5) the right to data portability, i.e. the right to receive personal data provided to the Controller and send them to another controller,
6) the right to object to processing of data based on the legitimate interest of the Controller or to processing for the purpose of direct marketing,
7) the right to lodge a complaint with the Polish supervisory authority or the supervisory authority of another Member State of the European Union competent for the place of habitual residence or work of the data subject or the place of the alleged infringement of the GDPR,
8) the right to withdraw consent at any time (without affecting the lawfulness of the processing based on consent before its withdrawal),
9) the right to obtain human intervention on the part of the Controller, to express one's own position and to challenge the decision based on automated data processing.

Transfer of personal data to other entities

Recipients of personal data may be, in particular, entities related directly or indirectly to El-Cab, in particular through organizational or personal measures, which would be based in one of the Member States of the European Union, as well as external service providers (e.g. IT service providers, entities providing marketing and promotional services, other entities processing data on behalf of El-Cab based on a personal data processing agreement), accountants, statutory auditors and auditors, lawyers, administrative bodies, state services and courts.
Personal data is processed on the premises of El-Cab. Personal data may be transferred to countries outside the European Union. In the event of transfer of personal data to a third country located outside the EU, El-Cab shall apply appropriate measures to ensure the security of your personal data.
El-Cab, in connection with the cooperation with its customers, suppliers and advisers, may entrust the processing of personal data to the above-mentioned entities. However, in any case, these entities shall be obliged to maintain the confidentiality of personal data and to process them in accordance with the provisions of personal data protection legislation and the relevant instructions from El-Cab.

No profiling

The Controller does not process personal data in an automated manner (including profiling).

Cookie policy

1. Cookie files (cookies) are IT data, in particular text files, which are stored on the end device of the website user (e.g. a computer, a tablet, a smartphone). Cookies usually contain the name of the website from which they originate, their storage time on the user's end device and a unique number.
2. 3. Cookies are used to:
a) adjust the website content to user preferences and optimize the use of the website; in particular, these files allow to recognize a website user's device and properly display the website, to suitable user's individual needs;
b) develop statistics that help to understand how users use the website to improve its structure and content,
c) tailor marketing communications to users.
4. The website uses two basic types of cookies: “session” cookies and “persistent” cookies. “Session” cookies are temporary files that are stored on the user's end device until the user leaves the website or exits the application (web browser). “Persistent” cookies are stored in the user's end device for the time specified in the cookie file parameters or until the user deletes them.
5. The website uses two following types of cookies:
a) “essential” cookies enabling the use of available website services, such as authentication cookies used for services that require authentication through the website;
b) cookies used to ensure security, e.g. are used to detect any authentication breaches on the website;
c) “performance” cookies which make it possible to collect information about the way in which use is made of the website pages;
d) “functional” cookies, allowing “saving” the settings selected by the user and personalizing the user interface, such as the language or region of the user's origin, the font size, the website appearance, etc.
e) “advertising” cookies, enabling us to provide users with advertising content tailored to their interests.
6. In many cases, the software used to browse the web (a web browser) allows for storing cookies on the user's device by default. Website users may change their cookie settings at any time. In particular, these browser settings can be changed so as to prevent automatic cookie support or notify the website user each time when a cookie is to be stored on their device. Details on cookie management options and methods are available in the software settings (of the web browser).
7. Restrictions on the use of cookies may affect some of the functionalities available on the website.
8. Cookies stored on the website user's end device may also be used by advertisers and partners cooperating with the controller.

Final provisions

The personal data controller may amend this Privacy Policy and Cookie Policy at any time, due to such reasons as technical changes to the website, new functionalities, etc. changes to this Privacy Policy and Cookie Policy shall be effective in the future, after the date of the amendment. The information on any amendment to the Privacy Policy and the Cookie Policy shall each time be posted on the website by the Controller.
